In the United Kingdom, the debate about how best to meet the shortfall of organs for transplantation has persisted on and off for many years. It is often presumed that the answer is simply to alter the law to a system of presumed consent. Acting perhaps on that presumption in his annual report launched in July, the Chief Medical Officer, Sir Liam Donaldson, advocated a system of organ donation based on presumed consent, the so-called “opt-out” system.1 He is calling for (...) a change in the law in England and Wales whereby consent to organ donation is presumed, making a person’s organs automatically available for transplantation after death, unless they registered objections to this while alive. Subsequently, the British Medical Association lent its support to the introduction of such a system.2 The BMA contends that “the practice of presumed consent legislation has had a significant effect on the number of cadaveric donors per million population.”2It is often taken for granted that there must be a correlation between the enactment of legislation on presumed consent and an increase in organ donation and procurement. However, the correlation is not as straightforward as it might seem. It may be that other practical measures to encourage organ donation could be implemented without changing the Human Tissue Act 2004, an Act which has been in force for barely a year.An analysis by Abadie and Gay demonstrated that “presumed consent legislation has a positive and sizeable effect on organ donation rates”,3 but they themselves admitted that the correlation between rates of donation and presumed consent legislation is “not completely unequivocal”.3 It is true that among the most successful cases in procurement rates are countries with presumed consent legislation . This paper addresses the scope behavior of bare nouns (BNs) in Kaingang (Jê, Brazil) and its relevance to the study of semantic variation. I show that Kaingang BNs exhibit variable scope in relation to other clause-mate operators, such as negation, intensional verbs, _if_-clauses, universal quantifiers, and frequency adverbials. Adopting a type-shifting framework (Chierchia in Topics in the syntax and semantics of infinitives and gerunds. PhD diss., University of Massachusetts, 1984 ; Events and grammar, pp. 53–103, 1998a ; Natural Language Semantics (...) 6: 339–405, 1998b ; Partee in Studies in discourse representation theory and the theory of generalized quantifiers, pp. 115–144, 1986 ; Krifka in Proceedings of SALT 13, pp. 180–203, 2003 ; Dayal in Linguistics and Philosophy, 27: 393–450, 2004, among others), I analyze Kaingang indefinite BNs as predicate NPs mapped into arguments via a choice function (CF) that gets existentially closed at any level in the clause, _à la_ English indefinites under Reinhart’s (Linguistics and Philosophy, 20(4): 335–397, 1997 ; Interface strategies: Optimal and costly computations, 2006 ) analysis. I also argue that the difference in scope properties across languages between variable-scope and narrowest-scope BNs is linked to the quantized/cumulative opposition of the predicates they express: the former are quantized predicates, while the latter are cumulative. I then claim that variable-scope and narrowest-scope BNs are created by two distinct type-shifters: the former by CF and the later by Krifka’s ∃ operator (Krifka in Proceedings of SALT 13, pp. 180–203, 2003 ). In this way, I propose that both operators are sensitive to the quantized/cumulative opposition and model this as conditioned by a binary semantic feature, namely [± quantizedness], which checks the (non-)quantized properties of the predicates that undergo type-shifting. The CF type-shifter is [+ quant], and thus defined only for quantized predicates, while Krifka’s ∃ type-shifter is [− quant], selecting only non-quantized ones. This analysis is shown to correctly predict the variation in scope properties of BNs across languages. (shrink)

Assuming that linguistic representation has been studied only by linguists using grammaticality judgments, Branigan & Pickering present structural priming as a novel alternative. We show that their assumptions are incorrect for cognitive-functional linguistics, exposing converging perspectives on form/meaning pairings between generativists and cognitive-functional linguists that we hope will spark the cross-disciplinary discussion necessary to produce a cognitively plausible model of linguistic representation.

Por ello, conocer cómo entienden y describen los estudiantes las capacidades y destrezas que están demostrando en ellos, es una información a tener en cuenta en momentos de cambio y reestructuraciones de los planes de estudio. En este artículo mostramos los resultados obtenidos en una investigación, en la que los estudiantes describen qué implica cada una de (...) las técnicas de evaluación que han realizado a lo largo de sus estudios de licenciatura y qué destrezas debían emplear en cada una de ellas. The purpose of this paper is to show through the concrete example of epileptic seizure anticipation how neuro-dynamic analysis and “pheno-dynamic” analysis may guide and determine each other. We will show that this dynamic approach to epileptic seizure makes it possible to consolidate the foundations of a cognitive non pharmacological therapy of epilepsy. We will also show through this example how the neuro-phenomenological co-determination could shed new light on the difficult problem of the “gap” which separates subjective experience from neurophysiological (...) activity. This perspective paper aims at discussing theoretical principles that could explain how emotion regulation and physical diseases mutually influence each other in the context of borderline personality disorder (BPD). Furthermore, this paper discusses the clinical implications of the functional relationships between emotion regulation, BPD and medical conditions considering dialectical behavior therapy (DBT) as a well-validated therapeutic intervention, which encompasses these issues. The inflexible use of maladaptive emotion regulation strategies (e.g., suppression, experiential avoidance, and rumination) might directly increase the probability of (...) developing physical diseases through a physiological pathway, or indirectly through a behavioral pathway. Some metabolic and chronic medical conditions could significantly impact emotional functioning through biological alterations involved in emotion regulation. Several empirical studies have shown high co-occurrence rates between BPD and several chronic physical diseases, especially ones linked to emotion-based maladaptive behaviors. DBT addresses physical diseases reported by individuals with BPD reducing problematic behaviors functionally associated to emotion dysregulation and identifying physical health as a goal forBuilding a Life Worth Living. The DAPRECO knowledge base is the main outcome of the interdisciplinary project bearing the same name. It is a repository of rules written in LegalRuleML, an XML formalism designed to be a standard for representing the semantic and logical content of legal documents. The rules represent the provisions of the General Data Protection Regulation, the new Regulation that is significantly affecting the digital market in the European Union and beyond. The DAPRECO knowledge base builds upon the Privacy Ontology, which provides (...) a model for the legal concepts involved in the GDPR, by adding a further layer of constraints in the form of if-then rules, referring either to standard first order logic implications or to deontic statements. If-then rules are formalized in reified Input/Output logic and then codified in LegalRuleML. Reified Input/Output logic is an application of standard Input/Output logic for legal reasoning, in which Input/Output logic is combined with the reification-based approach in Hobbs and Gordon. The DAPRECO knowledge base is then a case study for reified Input/Output logic, and it shows that the formalism indeed appears to be a good candidate to effectively formalize, via uniform and simple representations, complex linguistic/deontic phenomena that may be found in legal texts. To date, the DAPRECO knowledge base is the biggest knowledge base in LegalRuleML and Input/Output logic freely available online. (shrink)

Ethical, legal and social implications (ELSIs) in forensic genetics investigations (FGIs) also involve conducting a careful assessment of the potential benefits and responsible use of genetic information. FGIs have become an invaluable tool in solving crimes and identifying individuals in various legal and investigative contexts. Moreover, forensic geneticists are called on to manage a series of controversial aspects during the daily practice of forensic investigation, including informed consent, cases of unintended genetic findings, the proband’s privacy, post-mortem sample collection, misinterpretation of (...) results, and the correct management of genetic databases. In this scenario, this article aims to discuss the main aspects of ELSIs regarding FGIs, providing an opportunity to delve into the complexities and nuances of ethical decision-making in the context of FGIs, considering that justice should be served while upholding the highest ethical standards. To date, ELSIs in FGIs involve respecting human dignity, safeguarding privacy, ensuring justice, promoting social solidarity, and carefully weighing up risks and benefits. By adhering to these principles, the forensic geneticist can advance criminal justice while upholding individual rights and privacy. In this way, the development of clear guidelines and protocols can help navigate this ethical dilemma and ensure that FGIs are conducted with integrity, transparency, and respect for individual autonomy. In this paper, we bring together Foucault's biography and oeuvre to explore key concepts that support the analysis of nurses' acts of resistance. Foucault reflected on the power relations taking place in health services, making his contribution especially useful for the analysis of resistance in this context. Over three decades, he proposed a nonnormative philosophy while concomitantly engaging in transgressive practices guided by values such as human rights and social justice. Hence, Foucault's philosophy and public activism are an apparent contradiction, (...) but we argue that when analysed together they allow for a different understanding of his work. We describe the evolution of the concept of resistance in Foucault's work, supported by the approaches of Brent Picket (1996) and Miguel Morey (2013). Foucault started his work considering the idea of transgressiveness as it connects to being at the margins of society. He then spent considerable time elaborating the concept of power and identifying resistance strategies as forms of power exercise. In doing so, he considered that people engage with social change from multiple positions, including limited desire for change, fomenting reforms, or engaging in everyday revolutionary acts. As he further elaborated on power relations and defined resistance, Foucault asserted that resistance involves both repressive and productive dimensions of power, governance of biological life, state governance, and deliberate practices of illegalisms. Finally, Foucault shifted his attention to the freedom of ethical subjects, proposing the use of counter‐conduct and counter‐discourses to speak truth against oppression. Such framework offers a comprehensive lens for analysing nurses' acts of resistance within the complexities of the healthcare system and in society. In summary, Foucault's conceptual framework on resistance expands the role of nurses, to understand them not only as caregivers, but also as political agents capable of confronting and transforming oppressive institutional practices. California has focused on health equity in the state’s COVID-19 reopening plan. The Blueprint for a Safer Economy assigns each of California’s 58 counties into 1 of 4 tiers based on 2 metrics: test positivity rate and adjusted case rate. To advance to the next less-restrictive tier, counties must meet that tier’s test positivity and adjusted case rate thresholds. In addition, counties must have a plan for targeted investments within disadvantaged communities, and counties with more than 106 000 residents must (...) meet an equity metric. California's explicit incorporation of health equity into its reopening plan underscores the interrelated fate of its residents during the COVID-19 pandemic and creates incentives for action. This article evaluates the benefits and challenges of this novel health equity focus, and outlines recommendations for other US states to address disparities in their reopening plans. (shrink)

BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

A partir de la lectura de Une mort très douce, novela autobiográfica de Simone De Beauvoir, me propondré en este trabajo reflexionar sobre la noción merleau-pontiana de cuerpo vivido, particularmente en la experiencia del dolor. Más allá de las diferencias filosóficas específicas que la autora posee con Merleau-Ponty, me centraré en los préstamos que, efectivamente, ha tomado del fenomenólogo francés. Considero que Une mort très douce es un relato ejemplar que permite iluminar y profundizar algunas cuestiones que no han sido (...) lo suficientemente desarrolladas por Merleau-Ponty, a saber, la especificidad del estatus del cuerpo fenoménico sufriente hospitalizado, en una situación de enfermedad terminal. A su vez, la novela invita a reflexionar a partir de los límites establecidos entre normalidad/patología, y saber vulgar/saber científico presentados por Georges Canguilhem, que se articulan con la dimensión económica y política de la medicina como institución, señalada por Michel Foucault. Asimismo, en este texto la situación experiencial de la enfermedad permite a la filósofa revisitar su propio pensamiento desde una perspectiva más empática respecto de ciertas cuestiones sobre la maternidad sostenidas en Le deuxième sexe. De algún modo, el proceso de agonía de una persona se extiende intercorporalmente a quien está bajo su cuidado: así, este relato sobre el dolor es especialmente ilustrativo para señalar, con Merleau-Ponty, la imposibilidad de reducir el cuerpo a una descripción en tercera persona. Quoting Flaubert through time, Mieke Bal and Michelle Williams Gamaker’s Madame B brings Madame Bovary’s reflections on love and emotions to the present day, in a productive anachronism. Their work produces an intertemporal space where the past is relevant for the present, and the present enables us to understand the past. Intimacy and routine are central in their exploration of Flaubert’s contemporaneity. Those issues are precisely one of the keys in Karl Ove Knausgård’s project of literary autobiography, where he expands (...) narration foreclosing the ellipsis and giving visibility to small things and emotions; a project with some resonances with Munch’s crude-obscene uses of intimacy. This essay explores how both proposals, Bal and Williams Gamaker in film, and Knausgård in literature, can serve us to connect present and past sensibilities and, more than that, demonstrate resistances to the hegemonic discourses of temporality. La performatividad es un concepto relativamente reciente. J. L. Austin lo introdujo en la filosofía del lenguaje en la década de los cincuenta para designar aquellas expresiones que, en las circunstancias apropiadas, hacen justo aquello que dicen que hacen (como cuando alguien exclama «te lo prometo»). Desde entonces ha sido sometido a intensos procesos de discusión, crítica y resignificación que lo han conducido a terrenos de reflexión teórica, filosófica y política progresivamente alejados de su contexto originario. Este libro explora, entre (...) todos los trayectos posibles en el interior de estos debates, el modo en que la preocupación de Austin por comprender cómo hacemos cosas con palabras llegó a derivar en lo que Judith Butler, como feminista, como filósofa y como teórica queer, hace con la performatividad. Con este fin se atiende, en primer lugar, a un contexto genealógico en el que confluyen trabajos y discusiones explícitas sobre la performatividad lingüística (como los de Jacques Derrida, Jonathan Culler o Shoshana Felman) junto a la obra de otros autores que, si bien no la tratan explícitamente, ha-cen posible su particular recepción por parte de Butler, como Michel Foucault. En segundo lugar, se trata de entender la reformulación de la performatividad en el ámbito de las identidades sexuales y genéricas, con la que Butler desplaza género y sexo del conjunto de las cosas que somos al orden de las cosas que hacemos. Las relaciones entre cuerpo y lenguaje, materia y textualidad, sexo y género sufren así una transformación con efectos de largo alcance sobre la filosofía, los estudios de género y las políticas identitarias. El intercambio de críticas entre Butler y autores como Seyla Benhabib, Nancy Fraser o Pierre Bourdieu contribuye a entender parte de esos efectos, y también a profundizar en algunas de las prioridades políticas de nuestra autora: la resistencia a los efectos excluyentes de la normatividad genérica y, en particular, del sistema «dos sexos, dos géneros», en dirección a una versión más abierta, inclusiva y proliferante de la identidad. En este ensayo se hace una reflexión a partir de un hecho artístico: la realización del pintor colombiano Fernando Botero de una serie de cuadros basados en las fotografías que escandalizaron al mundo occidental, tomadas por los soldados estadounidenses en la prisión de Abu Ghraib en el 2004. Este hecho artístico nos permite analizar una necesidad humana que en tiempos de la pos modernidad parece haber sido superada: la escenificación pública del castigo. Las tesis que el filósofo Michel Foucault (...) presenta en su libro Vigilar y Castigar nos sirve como marco de referencia. Lo que en la era actual denominamos la World Wide Web permite a la humanidad comunicarse aceleradamente y pasar a la arena pública con una rapidez contraria a la reflexión, al detenimiento de la decisión racional. Toward a Postmodern Ethic of Radical Freedom is one of the first, if not the first, to bring Cornel West and Michel Foucault together in a meaningful dialogue to formulate "a postmodern ethic of radical freedom." This dialogue begins with the practical posture of West, more specifically his notions of truth and reality and work, then goes back to his more theoretical work to explore the same notions. As a project in constructive ethics, this book examines Cornel West's epistemology (...) (notion of truth) and metaphysics (notions of reality) as foundational components for a postmodern ethic of radical freedom. These foundational components are then brought into a discursive conversation with aspects of Michel Foucault's archaeology and genealogy, with a method called reconstruction. This reconstruction results in two important trajectories, radical ontology and radical epistemology, which become the pillars for a postmodern ethic of radical freedom. The last chapter of the book weaves together all components with the womanist work of Monica Coleman and Patricia Hill Collins as examples of this ethic of radical freedom. Practically speaking, this postmodern ethic of radical freedom serves as a platform to ensure transcendence so that all people, regardless of race, gender, or sexuality, can enjoy a flourishing and fulfilled life. J.‑C., le forum de Philippes est devenu une place de village, en fort contraste avec l’intense activité de construction d’églises qu’avait connue le centre de la ville dans la première moitié du siècle. Ce retour à la ruralité s’inscrit dans un courant plus général qui affecte alors les Balkans, mais la présente note étudie l’hypothèse que l’épidémie dite « peste de Justinien » a eu un fort impact à Philippes. Une vague connue à Constantinople (...) en 573‑574 a atteint Thessalonique en juillet 586 et a dû passer par Philippes. Ce facteur qui n’a pas été invoqué jusqu’ici pourrait expliquer les enterrements en masse très mal connus et mal datés observés par Paul Lemerle dans la basilique B, l’abandon de la construction de cette église en raison de la diminution des moyens financiers et surtout humains qui pouvaient lui être consacrés, et le déclin de la forme urbaine de la vie collective qui ne correspondait plus aux besoins d’une population devenue moins nombreuse. Written while the pandemic was still a key issue, this article tries to imagine the post-pandemic from different perspectives, and first of all in distinct temporalities. A question arises immediately: how can we consider the hypothesis of a deep cultural or anthropological mutation with intellectual or scientific tools that were forged before this mutation? What might new approaches for the social sciences look like? The article proceeds to analyse the more obvious social, technological and cultural changes that occurred with the (...) pandemic, which definitively modify our perception and understanding of globalisation. New or renewed inequalities, intergenerational tensions, racism, increasing fake news and conspiracy theory visions of the world, but also issues raised by feminism or ecology are at stake here. Depuis des temps immémoriaux, le loisir a existé sous les formes du jeu, de la tête, de la vie contemplative, créative ou récréative et, d'une façon générale, de la consommation de l'abondance lorsque cette dernière a pu être obtenue ou réalisée. Élément majeur d'un mode de vie pour les nantis et les classes privilégiées, épiphénomène plus ou moins occasionnel pour les masses dominées ou laborieuses, il acquerra graduellement un droit de cité plus étendu pour devenir, avec le XXe siècle, un (...) droit humain reconnu et constituer une dimension relativement structurante de nombreux aspects de la vie personnelle, sociale, économique, culturelle et sociopolitique des temps modernes. Ce faisant, le loisir accroît sans cesse la gamme des modes et styles de vie accessibles sur base de droit et d'exercice des libertés reliées à la citoyenneté, malgré et avec les forces sociales intéressées à son orientation et à sa programmation. Il s'inscrit de plus en plus comme un élément incontournable du développement culturel, sans oublier les considérations économiques et politiques dont il est aussi l'objet, de même que les questionnements éthiques que sa présence suscite. Michel Bellefleur nous présente ici une analyse critique de l'évolution contemporaine du loisir comme phénomène particulier d'une civilisation en marche malgré tous ses avatars, mais néanmoins ouverte à une quête constante de liberté, de tolérance, d'hédonisme ou d'eudémonisme, ainsi que d'une qualité de vie à construire.
